Summary

Recognises and vests the section 3 rights in forest dwelling Scheduled Tribes and other traditional forest dwellers whose occupation predates 13 December 2005. A vested right is heritable but not alienable or transferable, and is registered jointly in the names of both spouses. For land held under section 3(1)(a), the right is confined to the area actually occupied and may not exceed four hectares. No holder may be evicted until recognition and verification is complete. Rights are conferred free of encumbrances and of Forest (Conservation) Act clearance, net present value and compensatory afforestation. Resettlement from a critical wildlife habitat requires all six conditions in sub-section (2), including written Gram Sabha consent.
